DISTANCE SALES AGREEMENT

General Terms and Conditions


ARTICLE 1 – PARTIES

This Distance Sales Agreement (“Agreement”) is entered into electronically between:

Lara Arı (hereinafter referred to as “LARA ARI”)
and
the Buyer who purchases products through the website www.laraari.com.

By completing the order, the Buyer declares that they have read, understood, and accepted all provisions of this Agreement.


ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this Agreement is the determination of the mutual rights and obligations of the Parties regarding the sale of products offered by LARA ARI through its website, the payment of the sales price by the Buyer, and the delivery of the products to the address specified by the Buyer.


ARTICLE 3 – PRODUCTS AND PRICES ON THE WEBSITE

The main characteristics, sales prices, and other information regarding the products are available on www.laraari.com.

The prices listed on the website are sales prices and remain valid until updated.

Taxes, customs duties, and delivery costs are not included in the sales prices and shall be paid by the Buyer in accordance with the legislation of the Buyer’s country of residence.

Provided that stock and/or production conditions permit, the product shall be delivered within a maximum of 30 days.


ARTICLE 4 – DELIVERY

Products are delivered via a shipping company after payment confirmation, depending on stock or production availability.

Delivery costs and taxes are borne by the Buyer.

In case of delays caused by the shipping company, LARA ARI shall provide the necessary information; however, LARA ARI shall not be held responsible for delays caused by force majeure or the carrier.


ARTICLE 5 – RIGHT OF WITHDRAWAL AND RETURNS

For sales made to the European Union, the Buyer has the right to withdraw from the contract within 14 days from the date of delivery.

To exercise the right of withdrawal, the product must be unused, with tags attached, and in its original packaging.

The right of withdrawal does not apply to custom-made, made-to-order, or personalized products.

Return and exchange conditions are regulated in detail in the Return Policy, which constitutes an integral part of this Agreement.


ARTICLE 6 – BUYER’S DECLARATIONS AND OBLIGATIONS

The Buyer acknowledges that they have reviewed and obtained information regarding product features, prices, payment, and delivery conditions prior to placing the order.

The Buyer is obliged to inspect the product within a reasonable time after delivery and to notify LARA ARI immediately in case any defect is detected.

The Buyer declares that they have read the KVKK Personal Data Protection Information Notice available on www.laraari.com and consent to the processing of their personal data in accordance with applicable legislation.


ARTICLE 7 – RIGHTS AND OBLIGATIONS OF LARA ARI

LARA ARI is obliged to deliver the products in accordance with the ordered measurements and specifications.

LARA ARI shall not be responsible for incompatibilities arising from measurements or information provided by the Buyer.

Upon delivery of the products to the shipping company, the responsibility for delivery passes to the carrier.


ARTICLE 8 – INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All content, designs, visuals, texts, and products available on the website are the intellectual and industrial property of LARA ARI.

These materials may not be copied, reproduced, modified, or used for commercial purposes without permission.

Otherwise, the Buyer shall be subject to legal and criminal liability under applicable legislation.


ARTICLE 9 – FORCE MAJEURE

In the event of delivery delays due to force majeure events such as natural disasters, war, pandemics, transportation disruptions, or similar circumstances, LARA ARI shall notify the Buyer. Delivery shall be completed once the force majeure condition ceases.


ARTICLE 10 – GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by Turkish Law.

In the event of disputes, Istanbul Central (Çağlayan) Courts and Enforcement Offices shall have jurisdiction.

The provisions of Law No. 6502 on the Protection of Consumers are reserved.
